It is a civil lawsuit, and it depends on proving that another party’s negligence caused the death. This guide explains who can bring the claim, what Georgia law lets a family seek, and the deadline that matters most. Losing someone suddenly is hard, and many families are handling funeral plans, bills, and insurance calls at the same time.

What a Wrongful Death Claim Means After a Fatal Car Accident

A wrongful death claim is a civil lawsuit brought after a death caused by another person’s negligence or wrongful act. Negligence means careless conduct that causes harm. Civil means the case is separate from any criminal case. A criminal case asks whether a law was broken and what punishment applies. A wrongful death claim asks for money to address the family’s losses. Car, SUV, motorcycle, and commercial truck crashes can all lead to these claims when another party’s fault is established. For background, see our car accident resources page.

If your family lost someone in a Georgia crash, you don't have to sort out deadlines and insurance calls alone. If there is no surviving spouse, a child or children may bring it for a parent’s death, under O.C.G.A. § 51-4-2-pdf.pdf)-pdf.pdf)-pdf.pdf). Claims for a child’s death follow separate Georgia code sections, which a lawyer reviews case by case.

Sometimes no one in that group can file. If no one is entitled to sue under O.C.G.A. § 51-4-2 or § 51-4-4, the decedent’s administrator or executor may file the claim for the benefit of the next of kin, as provided in O.C.G.A. § 51-4-5-2017-pdf.pdf)-2017-pdf.pdf)-2017-pdf.pdf). An executor is named in a will. An administrator is appointed when there is no will. Both act as the personal representative, so families should confirm early who holds that role.

Questions about which relatives count can be complicated. Bring them to a consultation so they’re answered for your specific family. Spanish-language intake is available for families who want to talk through their situation in Spanish.

What a Family May Be Able to Recover

Georgia law lets a family seek the full value of the decedent’s life, as shown by the evidence. Lawyers also look at concrete losses. These can include lost income and support, the loss of the person’s companionship, and household help the person provided.

Some costs are easier to name. Under O.C.G.A. § 51-4-5-2017-pdf.pdf)-2017-pdf.pdf)-2017-pdf.pdf), when a death results from a crime or from criminal or other negligence, the deceased person’s personal representative is entitled to recover the funeral, medical, and other necessary expenses resulting from the injury and death. Georgia law, at O.C.G.A. § 51-12-1.1-pdf.pdf)-pdf.pdf)-pdf.pdf), limits special damages for medical and healthcare expenses to the reasonable value of medically necessary care, treatment, or services.

Two rules shape how money is shared. If there is a surviving spouse, O.C.G.A. § 51-4-2-pdf.pdf)-pdf.pdf)-pdf.pdf) divides the recovery equally among the spouse and the children, except that the spouse’s share can be no less than one-third. A recovery under that section is also not subject to the decedent’s debts or the estate’s debts. Some cases also involve injuries the person suffered before death. A lawyer reviews whether those apply.

The Two-Year Deadline and Why Early Steps Matter

In Georgia, actions for injuries to the person generally must be brought within two years after the right of action accrues, as set out in O.C.G.A. § 9-3-33-2023-pdf.pdf)-2023-pdf.pdf)-2023-pdf.pdf). The exact start date turns on the facts, and exceptions can change the timing. That is why families should not wait.

Evidence can disappear quickly. Useful items include:

The crash report and its report number

Scene, vehicle, and injury photos

Dashcam, traffic camera, and nearby business footage

Witness names and phone numbers

EMS, hospital, and medical records

The decedent’s phone, belongings, and vehicle documents

Trucking records also have a clock. The federal record-of-duty-status rule requires a motor carrier to keep the records of duty status and supporting documents for each of its drivers for at least 6 months from the date it receives them. Before you give an insurer a recorded statement or accept an offer, talk with a lawyer first.

How a Wrongful Death Claim Typically Proceeds

Claims often move through stages such as the six outlined below. The time each stage takes varies from case to case.

Free case review. A confidential, no-obligation talk about the crash, the person who died, and your questions.

Investigation. Gathering the crash report, medical and funeral records, footage, and witness statements.

Identifying responsible parties. Looking at the at-fault driver, the vehicle owner, any employer, and the insurance that may apply.

Notice and demand. Formal notice to insurers and a written demand that lays out the family’s losses with records.

Negotiation. Settlement talks, which can take months when many insurers or many documents are involved.

Lawsuit if needed. Filing in the proper Georgia court, then discovery (the exchange of records and sworn depositions), and mediation or trial if the case does not settle.

Commercial Trucks, Company Policies, and Multiple Defendants

When a commercial truck is involved, more than one party may share responsibility. The driver, the trucking company, and the vehicle owner may each be part of the picture. The Insurance Institute for Highway Safety publishes Fatality Facts on large trucks, including research on deaths in large truck crashes.

Federal rules limit driving time. Except as otherwise provided in § 395.1, a driver of a property-carrying commercial motor vehicle may not drive after a period of 14 consecutive hours after coming on-duty following 10 consecutive hours off-duty, according to the federal hours-of-service rule for property-carrying drivers. The federal hours-of-service rule for property-carrying trucks allows a driver to drive a total of 11 hours within the 14-consecutive-hour period that begins when the driver comes on duty after 10 consecutive hours off duty. Driver logs and trip records can show whether those limits were followed.

A federal statute on motor carrier financial responsibility directs the Secretary of Transportation to issue regulations requiring minimum levels of financial responsibility. These must be enough to satisfy liability amounts the Secretary sets for public liability, property damage, and environmental restoration for property transported by a motor carrier or motor private carrier between a place in a State and a place in another State, between two places in the same State through a place outside that State, or between a place in a State and a place outside the United States. Those minimums are set by regulation. They are not a measure of any claim’s value. Because commercial policies can play a role, identifying every available policy early matters.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Shapes the Value of a Wrongful Death Claim

There isn’t a standard amount for a wrongful death claim. Value turns on the decedent’s age, health, earnings, family relationships, the crash itself, and the insurance available.

Fault matters a great deal. Georgia’s comparative fault statute, O.C.G.A. § 51-12-33-pdf.pdf)-pdf.pdf)-pdf.pdf), requires damages to be reduced in proportion to the claimant’s percentage of fault. If the decedent is 50 percent or more responsible, no damages are recovered. Each liable party pays only its own apportioned share, not a joint share. The fault of everyone who contributed to the harm is considered, even people not named in the suit, and nonparty fault is considered if the plaintiff entered into a settlement agreement with the nonparty or if a defending party gives notice not later than 120 days prior to the date of trial that a nonparty was wholly or partially at fault.

Funeral bills, medical costs, and lost support are shown with receipts, bills, pay records, and tax documents.
