Under that arrangement, the lawyer is paid a share of what is recovered, not an hourly bill. The client may still be responsible for court costs and case expenses, even if there is no recovery.

Many people ask this question while dealing with hospital bills, time off work, or the death of a family member. You don’t have to decide anything yet. Understanding how fees work can help you think clearly about what comes next.

Personal injury attorneys commonly use contingent fees. Under a contingency arrangement, the attorney fee is charged only if there is a recovery, but the client may still be responsible for court costs and case expenses, even when there is no recovery. That is a helpful starting point, but the details live in your written agreement.

Our slip and fall claims resource covers the claim process in more detail.

How the Contingency Percentage Is Set

The percentage comes from the written fee agreement you sign with your lawyer. Each agreement sets its own terms, so the rate can vary from case to case. It is not something you can work out from a single rule of thumb.

Some agreements use one percentage for a claim that settles before a lawsuit is filed. They use a different percentage once litigation begins. Ask for each stage to be written out clearly, with the exact percentage listed.

The right terms depend on the facts of your case and what you agree to in writing. Timing also affects your options. Georgia’s general deadline for injury claims is two years after the right of action accrues, under O.C.G.A. § 9-3-33-2023-pdf.pdf)-2023-pdf.pdf)-2023-pdf.pdf). Waiting too long can narrow the choices you have. Read our filing deadline guide for Georgia slip and fall claims early.

Hourly and Flat Fees: Where They Appear

Hourly billing charges a set rate for each hour of work. A flat fee charges one set price for a defined service. Both arrangements appear in many kinds of legal work, from business matters to family matters.

Personal injury claims are commonly handled on a contingency basis instead. The fee depends on a recovery, so the lawyer’s pay is tied to the result. An hourly bill, by contrast, grows with each hour worked, whether or not money is recovered.

For an injured person with bills piling up, that difference matters. Any fee structure should be stated clearly before work begins. Ask which arrangement applies to your matter, and ask for the answer in writing so you can compare it with the other terms.

Case Costs and Expenses: The Part People Often Miss

Case costs are separate from the attorney’s fee. They are the out-of-pocket expenses needed to move a claim forward. Common examples include court filing fees, charges for medical and police records, deposition transcripts, and fees for reports from medical providers or accident reconstruction work.

Costs can add up, especially in a serious injury case with a long course of treatment. The agreement should say whether costs are repaid from a recovery, and how they are handled. Ask what happens to costs if the case ends without a recovery. Under a contingency arrangement, the client may still owe court costs and case expenses in that situation.

Evidence drives many of these costs. Medical records, photographs, and witness statements help show what happened and how it caused harm. Learn more in our guide on proving negligence in a slip and fall.

What Georgia Requires in a Contingency Fee Agreement

The signed fee agreement is the document that sets out your fee, so read it closely before you sign. Don’t rely on a verbal summary of the terms. Ask for the written version and take time to review it.

Ask your lawyer to explain each term in plain language. Confirm the percentage at each stage of the case. Find out whether costs come off before or after the fee is calculated. Ask what happens if you decide to end the representation.

Keep a signed copy for your records. If a term is unclear, ask about it before you agree. A good agreement should be easy to follow, and you should understand what you are signing.

How the Math Works: An Illustration, Not a Prediction

Two deductions reduce what a client keeps: the attorney’s fee and case costs. The order in which they are subtracted changes the result. The example below is hypothetical. It does not predict any outcome in any case.

Imagine a claim that resolves, and consider how a percentage fee and case costs would be subtracted from the total recovered.

If the fee is calculated on the full $100,000, the fee is $30,000. After subtracting costs, the client would receive $65,000.

If costs come off first, the fee is calculated on the remaining $95,000. That fee is $28,500. The client would receive $66,500.

The difference is $1,500 in this example alone. That is why the written agreement matters.

Medical bills and liens are separate from the attorney’s fee. Under Georgia law, special damages for medical expenses are limited to the reasonable value of medically necessary care, treatment, or services, as O.C.G.A. § 51-12-1.1-pdf.pdf)-pdf.pdf)-pdf.pdf) provides. Medical care given under a letter of protection, which is a promise to pay a provider from a settlement or judgment, is also treated specially under that statute. Review these items with your lawyer before any money is paid out.

Questions to Ask About Fees Before You Decide

Start with the basics. Ask about the percentage, the order of costs, and what you owe if nothing is recovered.

What percentage applies at each stage of the case?

Are costs deducted before or after the fee is calculated?

Am I responsible for court costs and case expenses if there is no recovery?

How are medical bills and liens handled before any payment is made?

Who will explain the agreement to me, and in which language?

Do personal injury lawyers charge if you do not win? Lawyers may not charge an attorney fee when there is no recovery, but the client may still owe case costs.

Does Georgia reduce compensation if I was partly at fault? Yes. Under O.C.G.A. § 51-12-33-pdf.pdf)-pdf.pdf)-pdf.pdf), the award is reduced in proportion to the injured person’s share of fault. A person who is 50 percent or more responsible cannot receive any damages.

Intake staff can take calls in English or Spanish.
