Whether you can get compensation after an Uber crash depends on who caused the crash, which insurance applies, and how serious your injuries are. This guide explains those pieces in plain language, using Georgia law. It is written for people hurt in a crash and for families trying to understand a loss.

Who Can Be Hurt in an Uber Crash, and Who Might Be Responsible

Passengers, drivers of other vehicles, pedestrians, and cyclists can all be hurt in a crash involving an Uber. Each person’s options can look different.

Responsibility can rest with the Uber driver, another motorist, the owner of a road hazard, or several parties at once. Many crashes involve more than one person whose actions played a part.

A passenger who did nothing to cause the crash stands in a different position than a driver whose own actions contributed to it. The roles of every driver involved matter when a claim is reviewed.

The driver’s app status matters too. Whether the driver was offline, waiting for a request, or carrying a passenger can change which insurance may apply. A later section explains those stages.

If you were a pedestrian or cyclist, the same questions apply. Who acted carelessly, and what did that carelessness cost you?

If a crash involving an Uber left you or someone you love hurt and facing medical bills, our team can talk through the details with you. Many injury claims turn on whether someone acted with reasonable care, and an attorney can explain how that question may apply to your situation. Common examples include distracted driving, speeding, running a red light, or making an unsafe turn.

Georgia uses a shared-fault rule. Under O.C.G.A. § 51-12-33-pdf.pdf), a judge reduces your damages by your percentage of fault. If you are 50 percent or more responsible, you cannot recover damages.

Georgia also has an avoidance rule. Under O.C.G.A. § 51-11-7-2017-pdf.pdf), if you could have avoided the consequences of the defendant’s negligence by using ordinary care, you are not entitled to recover.

Fault is often disputed. The other side may argue that you contributed to the crash. Police reports, photos, video, and witness statements help show what happened. Whether you can recover depends on the facts of your crash.

How Uber’s Insurance Works When the Driver Is on a Trip, Waiting, or Offline

The driver’s app status at the time of the crash often decides which insurance may apply. There are three basic stages. The app can be off, on and waiting for a request, or in a trip.

When the app is off, the driver is usually not working through the app. In that case, the driver’s personal auto policy often becomes the main source. Personal policies are written for personal driving, so coverage may be limited.

When the app is on and waiting, or a trip is underway, coverage provided through Uber may apply. That coverage is subject to the policy’s terms and limits. Each stage can involve different policies and conditions.

Georgia law generally requires auto liability policies to include uninsured motorist coverage. That coverage can apply when the at-fault driver has no insurance. Under O.C.G.A. § 33-7-11-pdf.pdf), an automobile liability policy issued or delivered in this state for a vehicle principally garaged or principally used in Georgia must include that endorsement or provision. O.C.G.A. § 33-7-11 reads: “(a)(1) No automobile liability policy or motor vehicle liability policy shall be issued or delivered in this state to the owner of such vehicle or shall be issued or delivered by any insurer licensed in this state upon any motor vehicle then principally garaged or principally used in this state unless it contains an endorsement or provisions undertaking to pay the insured damages for bodily injury, loss of consortium or death of an insured, or for injury to or destruction of property of an insured under the named insured’s policy sustained from the owner or operator of an uninsured motor vehicle, within limits exclusive of interests and costs which at the option of the insured shall be.”

Do not assume only one policy is involved. Ask about every policy that might apply to the crash.

How Much Money Can You Get If Your Uber Crashes?

No fixed amount applies to every Uber crash. The value of a claim depends on the injuries, the treatment, and the losses involved. Fractures, traumatic brain injuries, spinal injuries, hospital stays, ongoing care, and time away from work all affect the picture.

Medical bills follow a specific rule. Georgia law at O.C.G.A. § 51-12-1.1-pdf.pdf) limits special damages for medical and healthcare expenses to the reasonable value of medically necessary care, treatment, or services. The fact-finder decides that amount.

If you have any form of public or private health insurance, the evidence relevant to the reasonable value of medically necessary care, treatment, or services shall include both the amounts charged and the amounts actually necessary to satisfy those charges, regardless of whether the health insurance has been used. Treatment under a letter of protection also brings its own records into the case, including itemized charges.

The at-fault party’s available insurance is one practical limit on recovery. A claim can be worth more than the coverage that can pay it.

Types of Compensation After an Uber Accident

Injury claims usually seek money for losses caused by the crash. Economic losses have a bill or receipt behind them. Non-economic losses, such as pain, do not.

Economic losses can include medical bills, future medical care, lost wages, reduced earning ability, and out-of-pocket costs. Non-economic losses can include pain, suffering, emotional distress, and loss of enjoyment of life. Vehicle damage may be handled as a separate property claim.

Medicare may be involved if it paid for crash care. If Medicare or another health plan has paid for your treatment, questions about repayment can come up, so it is worth discussing them with an attorney early. The Centers for Medicare & Medicaid Services explains these rules.

Families of someone killed in a crash have a separate path. Georgia’s wrongful death statute, O.C.G.A. § 51-4-2-pdf.pdf), allows a surviving spouse, or a child or children if there is no surviving spouse, to recover the full value of the life of the decedent, as shown by the evidence. Medical records and bills are central evidence in every category.

Can You Sue If Your Uber Crashes?

Yes, you can generally bring a lawsuit, but timing is strict. Many claims start with insurers. A lawsuit may be needed if a fair resolution is not reached.

Under O.C.G.A. § 9-3-33-2023-pdf.pdf), except as otherwise provided in this article, actions for injuries to the person shall be brought within two years after the right of action accrues. Loss of consortium claims have four years under the same section.

Missing a deadline can prevent you from recovering. That is why reviewing timing early matters.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do I have to file?

Under Georgia’s general rule, most injury lawsuits must be filed within two years. Some claims, such as loss of consortium, have a longer period.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do I have to go to court to get paid?

Not always.
