Truck accidents often involve more parties and more paperwork than a typical car crash. A commercial truck is usually owned or leased by a company, and that company’s insurer may also be involved.

Your health comes first. Your records help show what happened and what the crash cost you. At the scene, if you can, write down the other driver’s name and insurance details, the truck company’s name, the time and place, and any witness names. Take photos of the vehicles, the road, and any visible injuries. Avoid guessing out loud about who was at fault.

If a commercial truck left you or someone you love hurt, and you're unsure what comes next, our team can talk it through with you in a free, confidential first consultation. The National Safety Council’s large-truck injury facts report that 5,340 people died in large-truck crashes in 2024. That was a 2.5% decrease from 2023, but up 30% over the past ten years.

We have not verified a current national share of all crashes that involve trucks, so this page does not give one. When you read any share, check two things. First, is it a share of all crashes, or only of fatal crashes? A truck can be a small share of total crashes but a larger share of deadly ones. Those two numbers answer different questions.

Second, check the year the data covers. Statistics describe patterns across many crashes. They don’t predict what happened in your crash or how your situation will turn out. The Insurance Institute for Highway Safety’s large-truck fatality facts page covers large-truck deaths and how people in passenger vehicles are affected in these crashes.

What Causes Most Truck Accidents

Most truck crashes have more than one cause. Investigators usually look at the driver, the truck, and the company’s records. Fatigue is a major concern. Under section 392.3 of the Federal Motor Carrier Safety Regulations, no driver shall operate a commercial motor vehicle, and a motor carrier shall not require or permit a driver to operate a commercial motor vehicle, while the driver’s ability or alertness is so impaired, or so likely to become impaired, through fatigue, illness, or any other cause, as to make it unsafe for him/her to begin or continue to operate the commercial motor vehicle.

Driver logs matter too. Under section 395.8 of the Federal Motor Carrier Safety Regulations, except for a private motor carrier of passengers (nonbusiness), a motor carrier subject to the requirements of that part must require each driver it uses to record the driver’s duty status for each 24-hour period.

Maintenance is another factor. Under section 396.3 of the Federal Motor Carrier Safety Regulations, every motor carrier and intermodal equipment provider must systematically inspect, repair, and maintain, or cause to be systematically inspected, repaired, and maintained, all motor vehicles and intermodal equipment subject to its control. That rule covers parts such as wheels and rims, suspension systems, and steering systems. Investigators also look at speed, distraction, impairment, and how cargo was loaded and secured. Each cause depends on the facts of the case.

Common Types of Truck Accidents

The common types of truck crashes include jackknifes, rear-end crashes into slowed traffic, lane-change and blind-spot crashes, wide turns, rollovers, underride crashes, and crashes tied to tire or brake failure or a shifted load. Each type brings different injuries and different questions about who is responsible.

A jackknife happens when the trailer swings around toward the cab. A heavy truck needs much more distance to stop than a passenger car, so rear-end crashes into slowed traffic are a serious risk. In a blind-spot crash, the truck driver may not see a car alongside. In an underride crash, a passenger car slides under a trailer, and the injuries can be severe.

A rollover can throw people from a vehicle or trap them inside it. A cargo shift can change how the truck balances and brakes. Tire or brake failure often points back to maintenance records. Knowing the crash type helps you and your medical team focus on the right injuries and the right evidence.

Who Can Be Responsible When a Commercial Truck Is Involved

Responsibility can reach the truck driver, the trucking company, and other businesses tied to the truck or its load. The company named first on a crash report is not always the only party with fault. Georgia uses a shared-fault rule. Under O.C.G.A. § 51-12-33-pdf.pdf)-pdf.pdf)-pdf.pdf), the judge reduces an award in proportion to the injured person’s own share of fault.

That same statute says a plaintiff who is 50 percent or more responsible for the injury recovers nothing (O.C.G.A. § 51-12-33). Under O.C.G.A. § 51-12-33, when a plaintiff is to some degree responsible for the injury or damages claimed, the judge shall reduce the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault. Each liable defendant pays only its own apportioned share, and those shares are not joint liability. The fault of all persons who contributed to the injury is considered, even if they were not named in the suit.

Federal law can also shape who may be held responsible. In 2026, the U.S. Supreme Court’s opinion in Montgomery v. Caribe Transport II held that a state-law claim that a broker negligently hired an unsafe motor carrier falls within a federal safety exception. That means federal law does not block that kind of claim. Whether any claim succeeds depends on the facts.

Medical Care and Documentation After a Truck Crash

See a medical doctor soon after a crash. Prompt care protects your health and creates a clear record of your injuries. Some injuries do not show their full effects right away. Neck pain, back pain, headaches, and dizziness can grow over days, so tell your doctor about every symptom, even small ones.

The spinal cord is protected by three layers of tissue, and cerebrospinal fluid surrounds it as a cushion against shock. Spinal nerves are named C1 to C8 in the neck, T1 to T12 in the upper mid-back, L1 to L5 in the lower back, and S1 to S5 in the sacral region. Each group controls different body regions. High cervical injuries can affect breathing.

Keep your own simple record. Write down daily pain, sleep, activities you can’t do, and every missed day of work. Save bills, receipts, and mileage to appointments. Follow discharge instructions and attend recommended follow-up visits. Gaps in treatment can be hard to explain later, so keep your appointments.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Crash Reports and Evidence That Can Disappear

A Georgia crash report is the official record of the crash. It usually lists the vehicles, the people involved, and what the responding officer observed. Ask the agency that responded how to get a copy, because the process can vary.

Trucking evidence can be lost. Under section 395.8 of the Federal Motor Carrier Safety Regulations, a motor carrier subject to that part must retain records of duty status and supporting documents required under this part for each of its drivers for a period of not less than 6 months from the date of receipt. Under section 396.3 of the Federal Motor Carrier Safety Regulations, records required by that section shall be retained where the vehicle is either housed or maintained for a period of 1 year and for 6 months after the motor vehicle leaves the motor carrier’s control.

The federal rules also bar carriers from altering or erasing the original hours-of-service information, under section 395.30 of the Federal Motor Carrier Safety Regulations. Electronic logging device data, dashcam video, dispatch messages, and cargo papers may be overwritten or thrown away on their own schedules. Early written requests asking the trucking company to keep its records are a common step in these cases.

Insurance, Medical Bills, and the Commercial Policy

Trucking companies usually carry commercial liability insurance. Federal law provides that, for motor carriers transporting property, mainly in interstate commerce, the Secretary of Transportation shall prescribe regulations to require minimum levels of financial responsibility sufficient to satisfy liability amounts established by the Secretary covering public liability, property damage, and environmental restoration, as described in section 31139 of the United States Code.

Georgia limits when a motor carrier’s insurer can be added to a lawsuit. Under O.C.G.A. § 40-2-140-2024-pdf.pdf)-2024-pdf.pdf)-2024-pdf.pdf), joinder is allowed only in specified situations.

Medical bills follow their own rules. Under O.C.G.A. § 51-12-1.1-pdf.pdf)-pdf.pdf)-pdf.pdf), medical expenses are limited to the reasonable value of medically necessary care. If you have health insurance, the evidence can include both amounts charged and amounts actually needed to satisfy charges under the insurance contract. Health insurance, medical payments coverage on your own policy, and other benefits are categories to ask about, not sources of payment you can count on.

An insurer may contact you early. Recorded statements and quick releases deserve care. Before you sign anything, ask what it covers. Our site’s article on commercial truck insurance covers commercial policies in more detail.

Georgia Deadlines and Fault Rules

Georgia’s general deadline for injury claims is two years. Under O.C.G.A. § 9-3-33-2023-pdf.pdf)-2023-pdf.pdf)-2023-pdf.pdf), actions for injuries to the person must be brought within two years after the right of action accrues. Actions involving loss of consortium have four years under the same statute.

For traumatic injuries, the period generally runs from the date of injury, so don’t rely on a guess about when it started. Some situations follow different rules, and this page does not list every deadline or notice requirement. Claims involving government entities are not covered here at all.

Timing also affects proof. Memories fade, and records can be discarded on their own schedules, as described above. Waiting can make evidence harder to gather. That is a practical point, not a prediction about how any case will turn out.

Wrongful Death, Brain and Spinal Injuries, and Catastrophic Harm

When a truck crash causes a death, Georgia’s wrongful-death statutes govern who may bring the main claim (O.C.G.A. §§ 51-4-2, 51-4-4). Under O.C.G.A. § 51-4-5-2017-pdf.pdf)-2017-pdf.pdf)-2017-pdf.pdf), when death results from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses from the injury and death.

Serious brain and spinal injuries often need long-term care. Records of that care matter over time. Some symptoms of a head injury take time to show. Spinal injuries can change movement, feeling, and breathing, depending on where the nerves are hurt. Keep every treatment record, including notes about symptoms that change.

Catastrophic harm also changes daily life. Work, family roles, and independence can all be affected. Documenting those changes with your medical team and your own records gives a clearer picture of what happened. We cannot say what any case is worth.

Talking Through Your Truck Crash With Our Team

Ugwonali Law offers a free, confidential first consultation with no obligation to continue.
