In Georgia, a surviving spouse may bring the claim. If there is no surviving spouse, a child or children may bring it. This guide explains who can file, how long families have, which records matter most, and how any recovery is divided. It also links to our detailed pages on each part.

What Wrongful Death Means in Georgia

A wrongful death claim is a civil case. It asks for money to make up for a family’s loss after a death caused by someone else’s fault. Negligence means a person failed to use reasonable care, and that failure caused harm. In a fatal crash, that might be a driver who ran a red light. In a fatal fall, it might be a property owner who ignored a known hazard.

A criminal case is different. The state brings criminal charges to address conduct. The family does not bring those charges, and the family’s civil claim is separate. Families often hear both terms at once, so the difference matters.

This page is a starting map. Each section points to a deeper guide, so you can read more about the part that fits your family’s situation.

If your family is facing a fatal crash and the questions keep piling up, you don't have to sort them out alone. Each one turns on who was at fault and what caused the death.

Truck and commercial vehicle crashes. When a commercial truck is involved, the carrier’s insurance may be part of the picture. Federal law sets minimum financial responsibility levels for motor carriers. 49 U.S.C. § 31139 directs the Secretary of Transportation to prescribe those minimums. Those amounts are floors. They do not set what any one case is worth. Learn more about truck accidents.

Car and passenger vehicle crashes. Some crashes between cars, or involving passenger vehicles, cause deaths at the scene or later in the hospital. See car accidents for more on how these cases are handled.

Premises liability and slip-and-fall incidents. A fatal fall on unsafe property can lead to a claim when the owner’s fault caused the death. Read about premises liability and slip and fall cases.

Traumatic brain and spinal cord injuries. Some people survive the first hours after a serious crash or fall but die later. Those deaths often follow a traumatic brain injury or a spinal cord injury. Families in those weeks face hard medical choices and many questions.

How Long Families Have to File in Georgia

Georgia generally gives two years to bring an action for injuries to the person, except for injuries to the reputation, which have one year, and actions for injuries to the person involving loss of consortium, which have four years. O.C.G.A. § 9-3-33 says actions for injuries to the person must be brought within two years after the right of action accrues, except for actions involving loss of consortium, which must be brought within four years after the right of action accrues. Families should not treat that number as a safe date without checking their own timeline. The starting point can turn on the specific facts of the case.

A related criminal case can change the timing. O.C.G.A. § 9-3-99 pauses the limitations period for a tort claim brought by the victim of an alleged crime committed in Georgia, when the claim arises out of the facts and circumstances of that crime. The pause runs from the date of the alleged crime or act until the prosecution becomes final or is otherwise terminated. That pause generally cannot exceed six years, except as otherwise provided in O.C.G.A. § 9-3-33.1.

Acting early also helps. Witnesses’ memories fade, records get harder to locate, and physical evidence can be lost. Early action gives a family more time to gather what it needs. You can read more about the Georgia wrongful death statute of limitations.

The First Records to Protect After a Fatal Crash

The records a family gathers early can shape the claim later. The key records are the crash report, hospital and emergency records, the autopsy report, and every funeral and medical receipt.

The crash report. The report records the scene, the parties, and what the investigating officer noted at the time. Families should keep a copy and any photos or witness names they have. Read more about the fatal crash report in Georgia.

Medical records. Hospital and emergency records show the injuries and the treatment. See our guide to medical records after a fatal crash.

The autopsy report. The autopsy report can document the cause of death and how injuries relate to it. Families should ask for it and keep the copy safe. More on autopsy and forensic reports is available.

Funeral and burial costs. When death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses. Necessary expenses from an injury are also a legitimate item in damages. Keep every invoice and receipt. See funeral and burial costs in Georgia.

Criminal Charges and a Civil Wrongful Death Claim

A criminal case and a civil wrongful death claim are separate proceedings. The state prosecutes criminal charges. The family brings the civil claim to seek compensation. The two have different goals and follow different procedures.

Families should not assume that one track settles the other.

Under O.C.G.A. § 9-3-99, the running of the period of limitations with respect to any cause of action in tort that may be brought by the victim of an alleged crime which arises out of the facts and circumstances relating to the commission of such alleged crime committed in this state shall be tolled from the date of the commission of the alleged crime or the act giving rise to such action in tort until the prosecution of such crime or act has become final or otherwise terminated, provided that such time does not exceed six years, except as otherwise provided in Code Section 9-3-33.1. If the injured person dies and there is no right of survivorship in any other person, the cause of action survives to the personal representative. Put simply, the injured person’s own claim does not end at death.

A wrongful death claim covers the family’s losses from the death. A survival action covers the injured person’s own losses from the injury. Both can matter in one case. Read more about the survival action in Georgia.

A person can live for days or weeks in the hospital before dying. A death that comes later can still be tied to the crash. Medical records and the autopsy report help show how the injuries led to the death. Families should keep every discharge summary and treatment note. See our guide to deaths that occur weeks after a crash.

How Wrongful Death Damages Are Calculated and Distributed

Georgia law starts with the full value of the decedent’s life. O.C.G.A. § 51-4-2 lets the surviving spouse, or if there is no surviving spouse, a child or children, recover the full value of the life of the decedent, as shown by the evidence. The trier of fact, usually a jury or a judge, decides the amount from the evidence.

O.C.G.A. § 51-12-2 says general damages are those the law presumes to flow from any tortious act, and they may be recovered without proof of any amount. Special damages actually flow from the act and must be proved. Medical and funeral bills are examples of costs families must document.

Georgia also sets how a recovery is shared. O.C.G.A. § 51-4-2 provides that any recovery is equally divided, share and share alike, among the surviving spouse and the children per capita, with the descendants of children taking per stirpes. The surviving spouse, however, shall receive no less than one-third of that recovery as the spouse’s share. The same section says the recovery is not subject to the decedent’s debts.

Fault can also reduce a recovery. When the plaintiff is to some degree responsible for the injury, O.C.G.A. § 51-12-33 requires the judge to reduce the plaintiff’s damages in proportion to his or her percentage of fault. A plaintiff found 50 percent or more responsible for the injury or damages claimed is not entitled to receive any damages. Each liable party’s share is its own, not joint.
