A wrongful death example is a death caused by another person’s or company’s negligent or wrongful act. Common examples in Georgia include a fatal truck crash, a fatal car crash, a fatal fall on unsafe property, a fatal slip or trip and fall, and a death that follows a serious brain or spinal cord injury. This page walks through each scenario in plain language. It also explains who may bring a claim under Georgia law and what does not count. This is educational content, not legal advice about your own situation.

What Wrongful Death Means in Georgia

A wrongful death is a death that another party’s negligence caused, and Georgia law lets certain family members bring a civil claim for it. Negligence, in plain terms, is the lack of the care an ordinarily prudent person would take in similar circumstances (O.C.G.A. § 51-1-2). A wrongful death claim is a civil lawsuit. It is separate from any criminal case.

Georgia’s statute sets out who may bring the claim first. A surviving spouse may recover the full value of the decedent’s life. If there is no surviving spouse, a child or children may recover (O.C.G.A. § 51-4-2). When no person is entitled to bring the wrongful death action under Code Section 51-4-2 or 51-4-4, the administrator or executor of the decedent may bring it for the next of kin (O.C.G.A. § 51-4-5).

For a broader overview, see our Georgia wrongful death law guide.

If you're piecing together what happened to someone you love after a crash or a fall, you don't have to sort out the legal questions alone; our team can talk them through with you. Picture a tractor-trailer that drifts into a lane on a busy metro Atlanta interstate and strikes a passenger car. The driver of the car dies at the scene or later from injuries.

If the duty of ordinary care is not met and that failure causes a death, the family may have a claim. Georgia law also makes a person liable for torts committed by a servant within the scope of that person’s business (O.C.G.A. § 51-2-2). When a company or carrier is involved, the facts about who employed the driver and which insurance applies are part of the review.

Families often need to gather the crash report, medical records, and employment information early. Our guide on what qualifies as negligence explains the basic elements in more detail.

Example Two: A Fatal Car Crash Caused by a Driver’s Negligence

A fatal car crash is another wrongful death example when one driver’s careless act causes a death. Common examples include running a red light, driving while distracted, or crossing the center line. The victim may be a pedestrian, a cyclist, or another motorist.

Georgia law requires every driver to exercise due care to avoid colliding with any pedestrian on a roadway (O.C.G.A. § 40-6-93). When a driver breaks that duty and a pedestrian dies, the family’s claim centers on whether that conduct caused the death.

A death does not always happen at the scene. Some people die days or weeks later after hospital care. When the crash caused the death, that delayed death can still fit the wrongful death definition.

A plaintiff who is 50 percent or more responsible for the injury cannot receive damages (O.C.G.A. § 51-12-33). Other fault arguments are weighed the same way: a plaintiff’s share of fault below 50 percent reduces damages in proportion to that share, and a plaintiff who is 50 percent or more responsible may not recover any damages.

Example Three: A Fatal Fall on Unsafe Property

A fatal fall on unsafe property is a wrongful death example when a property owner’s failure to keep the premises safe causes a death. Picture a broken stair railing, a rotted deck, or a failing walkway. A visitor falls and dies after the hazard gives way.

Georgia law says an owner or occupier who invites people onto the land for a lawful purpose must use ordinary care to keep the premises and approaches safe. The owner is liable for injuries caused by a failure to do so (O.C.G.A. § 51-3-1). Questions often include whether the owner knew, or should have known, about the hazard.

Families often gather photographs, maintenance records, incident reports, and the medical timeline after the fall. Those records help show how the hazard and the death connect. The facts of each property and each fall are different, so the details matter.

Example Four: A Fatal Slip and Fall or Trip and Fall

A slip or trip that leads to a death is a wrongful death example, even when the fall seems minor at first. Picture an older adult who slips on an unmarked wet floor in a store. The fall causes a hip fracture and a head injury. The person dies after weeks of hospital care.

These cases often turn on several questions. Did the owner know about the wet floor? How long had it been there? Were warnings or cleanup reasonable under the circumstances? Georgia’s premises liability law is set out in O.C.G.A. § 51-3-1

Complications can follow a fall. The medical records from the time of the fall help the family understand what happened. Our page on common grounds for a wrongful death claim covers these patterns.

Example Five: A Death After a Traumatic Brain or Spinal Cord Injury

A death that follows a traumatic brain or spinal cord injury can be a wrongful death example. This applies when the original negligent act caused the injury and the injury led to the death. The sequence usually looks like this: a crash or fall causes the injury, the person receives hospital care, a medical doctor treats the injury, and later the person dies from complications.

The medical records and the treating doctors’ notes are central to showing that link. They show what the injury was, how it was treated, and what complications followed. Families often face hard decisions about care while also learning the legal process. That is one reason many families find it helpful to keep copies of records and a written timeline.

Catastrophic injuries can lead to long hospital stays. The medical timeline is best understood step by step, with each record tied to a date. Each case is different, and the medical facts decide how the link is shown.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What Is Not an Example of Wrongful Death

A death from natural causes generally is not a wrongful death example. A death from an illness that another party’s negligent act did not cause also does not fit the definition. In general, ordinary diligence is that degree of care which is exercised by ordinarily prudent persons under the same or similar circumstances. The absence of such diligence is termed ordinary negligence (O.C.G.A. § 51-1-2).

A death with no connection to another person’s or company’s conduct is not one of these examples. Whether a particular death fits the definition turns on the cause of death, the medical records, and the conduct of others involved.

A minor fender-bender with no serious injury is also outside these examples. Serious harm and a clear link to the death are what separate a wrongful death case from a sad but unrelated loss.

What a Family May Seek After a Wrongful Death in Georgia

Under the statute, the surviving spouse, or if there is no surviving spouse, a child or children, may seek the full value of the decedent’s life, as shown by the evidence (O.C.G.A. § 51-4-2).
