In most cases, the grounds rest on negligence. That means someone else’s careless or wrongful conduct caused a person’s death. This guide explains those grounds in plain words for families facing a loss they did not expect. It covers serious crashes, unsafe property, and deaths that follow catastrophic injuries in Georgia.

What a Wrongful Death Claim Is Based On

A wrongful death claim is a civil lawsuit brought after a person dies because of another party’s wrongful conduct. It asks who is legally responsible for the loss. Georgia’s wrongful death statute, O.C.G.A. § 51-4-2, provides that a surviving spouse or, if there is no surviving spouse, a child or children may recover for the homicide of the spouse or parent the full value of the life of the decedent, as shown by the evidence. If there is no surviving spouse, a child or children may bring the claim.

The civil claim is separate from any criminal case. A criminal case asks whether the law was broken and what penalty applies. A civil claim asks who must answer for the harm. The two can move along separate paths.

If you are reading this while grieving, you don’t need to absorb every term today. Take it one step at a time. Write down the facts you already know, while they are fresh.

If you are carrying a loss and trying to understand what happened, you don't have to figure it out alone. A driver must exercise due care to avoid colliding with any pedestrian on a roadway, under O.C.G.A. § 40-6-93. A property owner who invites visitors must use ordinary care to keep the premises safe, under O.C.G.A. § 51-3-1.

Breach means the person failed to meet that duty. Running a crosswalk signal or leaving a known hazard unrepaired are examples.

Causation links the careless act or unsafe condition to the death. Medical records, crash reports, and witness accounts often help show that link.

Damages are the harms the family may pursue. For a deeper look at these elements, read our negligence elements in Georgia guide.

Fatal Truck and Car Crashes

In a fatal crash, the most common grounds are driving choices that break the rules of the road. These include speeding, distraction, impairment, running a red light, and failing to yield.

The Insurance Institute for Highway Safety says speeding can increase both the likelihood and the severity of a fatal crash.

Commercial trucks raise added questions. Federal rules limit driving hours. Under 49 C.F.R. § 395.3, a driver may not drive after a 14-hour period that begins after 10 consecutive hours off duty. Under 49 C.F.R. § 392.3, a driver may not operate a commercial motor vehicle while fatigue, illness, or any other cause impairs, or is likely to impair, the driver’s ability or alertness so as to make it unsafe. Under 49 C.F.R. § 396.3, carriers must systematically inspect, repair, and maintain their vehicles. Under 49 C.F.R. § 393.106, cargo must be firmly immobilized or secured, except commodities in bulk that lack structure or fixed shape (e.g., liquids, gases, grain, liquid concrete, sand, gravel, aggregates) and are transported in a tank, hopper, box, or similar device that forms part of the vehicle’s structure.

Records can show what a carrier did and when. Crash reports, vehicle data, and medical records help piece together a fatal collision.

Deaths From Unsafe Property, Slip and Falls, and Trip and Falls

A death from a fall can support a claim when a property owner or occupier failed to keep the property reasonably safe. Georgia’s rule, O.C.G.A. § 51-3-1, applies to people who came onto the property for a lawful purpose by invitation.

Common hazards behind fatal falls include wet floors without warning, broken stairs or handrails, and uneven walkways. Each one raises a question about what the owner knew.

The facts about who knew what, and when, often shape the claim. Was the hazard visible? How long was it there? Did the owner repair it or warn visitors? Those answers matter. For Georgia-specific detail, see wrongful death premises liability.

Deaths After Catastrophic, Brain, or Spinal Cord Injury

A person may be hurt in a crash or fall, receive hospital care, and die later. The death may come some time after the first injury.

Medical records often connect the original injury to the later death. Useful records include hospital notes, imaging results, and the treating doctor’s notes. Look for records that tie the first injury to the cause of death.

A later death can still be the subject of a claim when the medical connection is documented. Each case is reviewed on its own facts.

Keep copies of medical records and bills as they arrive. Organized records make the timeline easier to review. Our pages on traumatic brain injury and spinal cord injury explain these records in more detail.

Are Wrongful Death Cases Hard to Pursue?

Wrongful death claims require proof of fault. They also require proof that the fault caused the death. Gathering that proof can take time.

Georgia uses modified comparative fault. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault. A plaintiff who is 50 percent or more responsible recovers nothing. Under O.C.G.A. § 51-12-33, the judge reduces the damages otherwise awarded to a plaintiff who is to some degree responsible for the injury or damages claimed, in proportion to the plaintiff’s percentage of fault, and the plaintiff is not entitled to receive any damages if the plaintiff is 50 percent or more responsible. Each defendant pays only its own apportioned share.

Disputes over fault and insurance coverage can arise. That is one reason careful investigation matters. Whether a particular claim succeeds depends on the facts, the evidence, and the applicable law. A short summary like this cannot predict that result.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Time Limits to Keep in Mind

Georgia’s general limit for injury-to-person actions is two years after the right of action accrues.

A spouse’s claim for loss of consortium, meaning the loss of the marriage relationship, must be brought within four years after the right of action accrues, under O.C.G.A. § 9-3-33.

Under O.C.G.A. § 51-4-2, a surviving spouse must receive no less than one-third of any recovery under that subsection.
