It depends on the facts, and no one can predict the result before those facts are known. In Georgia, a family’s claim turns on proof: who was at fault, what caused the death, and what the family lost. This page explains those pieces in plain terms so you can understand the process before you decide anything. It is general information, not legal advice.

What “Winning” a Wrongful Death Case Actually Means

Winning usually means the family reaches a fair resolution of its claim. That can happen through a settlement, a verdict after trial, or a dismissal.

A settlement is an agreement to resolve the claim in exchange for a payment. A verdict is the decision a jury reaches after trial. A dismissal ends the case without a payment to the family.

Many wrongful death cases settle before trial, and some do go to trial. Because most cases end before a jury decides, “winning” often means a result that fairly reflects the family’s claim.

A case can be strong on who caused the death and still be hard. Proof can be difficult. Collecting from the at-fault party can be difficult. Timing can be difficult. Strong facts do not always mean a quick or simple result.

If a crash or fall took someone you love, you may be sorting through reports and insurance calls right now; our team can walk through what your family may have a claim for. Negligence cases are usually discussed in terms of a few core questions, and each case turns on its own facts. Did the other side owe a duty of care? Did it break that duty? Did that break cause the harm?

Georgia’s wrongful death statute lets a surviving spouse recover, or if there is no surviving spouse, a child or children, “the full value of the life of the decedent, as shown by the evidence” (O.C.G.A. § 51-4-2). The words “as shown by the evidence” matter. Value is not assumed. It must be proved.

Causation is the link between the act and the death. The family must connect the at-fault party’s conduct to the death itself. For example, if a driver ran a red light and a crash followed, the records must show that the collision caused the fatal injuries.

The family’s losses must also tie back to the death. Each case turns on its own facts and evidence.

Who Can Bring the Claim and the Filing Deadline

A surviving spouse can bring the claim. If there is no surviving spouse, a child or children can bring it (O.C.G.A. § 51-4-2).

If no one is entitled to sue under O.C.G.A. § 51-4-2 or § 51-4-4, the decedent’s administrator or executor can sue for the benefit of the next of kin (O.C.G.A. § 51-4-5(a)). The estate’s representative may file the claim only when no one is entitled under O.C.G.A. § 51-4-2 or § 51-4-4.

Georgia law sets a two-year deadline for actions for injuries to the person, counted from when the right of action accrues, except that injuries to reputation must be brought within one year and loss of consortium actions within four years (O.C.G.A. § 9-3-33). Other rules can change that date, so do not assume two years is the whole story.

One rule can pause the clock.

Early action matters even when the deadline seems far away. Video gets overwritten, witnesses move, and memories fade. Start preserving evidence now.

Why Some Wrongful Death Cases Are Harder to Prove

Cases get harder when evidence is lost, fault is disputed, or several parties share blame. Each problem can slow a claim or shrink what it recovers.

Evidence disappears fast. Vehicle data, dash camera footage, surveillance video, and maintenance records can be overwritten or thrown away. Once they are gone, the family may have a harder time proving what happened.

Causation can also be disputed. The defense may argue the death had another cause, such as an existing medical condition. The family then needs medical records that link the injury to the death.

Several parties can share blame. Georgia apportions damages by each party’s percentage of fault. Damages are not joint, and they are not subject to contribution (O.C.G.A. § 51-12-33(b)). That means each liable party answers for its own share.

A defendant can also point to someone who was not sued. Fault of a nonparty counts if the plaintiff entered into a settlement agreement with that nonparty, or if a defending party gives notice, not later than 120 days prior to the date of trial, that a nonparty was wholly or partially at fault. The notice shall be given by filing a pleading in the action designating the nonparty and setting forth the nonparty’s name and last known address, or the best identification of the nonparty which is possible under the circumstances, together with a brief statement of the basis for believing the nonparty to be at fault (O.C.G.A. § 51-12-33(d)(2)).

A company may be tied to a contractor’s conduct. An employer can be liable for a contractor’s negligence in listed situations, including when it keeps the right to control the time and manner of the work (O.C.G.A. § 51-2-5).

What Makes a Wrongful Death Claim Easier to Support

Claims are usually easier to support when records clearly show how the death happened. Good records build a timeline that others can check.

Police and crash reports, coroner or medical examiner records, and hospital records are a strong start. They show how the death occurred and what medical care followed.

Witness statements, photographs, and inspections of the scene or vehicle also help. Physical evidence often shows what a written report does not.

For truck crashes, driver logs, inspection and maintenance records, and dispatch records can matter a great deal. They can show whether rules and schedules were followed.

For slip and fall or other premises cases, incident reports, inspection history, and prior complaints about the same hazard can matter. A record of earlier warnings can show the owner knew about the problem.

Families can help now. Keep the vehicle, clothing, and damaged items until someone has reviewed them. Save every bill, receipt, and letter from an insurer. Write down the timeline while memories are fresh.

How Long These Cases Usually Take

Timelines vary widely, and no fixed number fits every family. The length depends on how much evidence exists, how many parties are involved, and how busy the court is.

Most claims move through three stages. First comes investigation and gathering records. Next comes a demand or negotiation with the insurer. If that stalls, the case may be filed in court.

After filing, both sides exchange records and testimony in a process called discovery.

If a case goes to trial, it can take days, weeks, or longer. Many cases settle before that point. Cases with many parties and long medical timelines usually take more time.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Damages Are Measured in a Georgia Wrongful Death Case

Georgia measures a wrongful death recovery by the full value of the decedent’s life, as shown by the evidence (O.C.G.A. § 51-4-2). The jury or the parties weigh the evidence to reach that value.

If there is a surviving spouse, the spouse receives no less than one-third of the recovery as the spouse’s share. The whole recovery is divided equally, share and share alike, among the surviving spouse and the children per capita, but the surviving spouse’s share can never be less than one-third of the total (O.C.G.A. § 51-4-2).

A recovery under this statute is not subject to the decedent’s debts or the estate’s debts (O.C.G.A. § 51-4-2).

Funeral, medical, and other necessary expenses can also be part of the claim when death results from a crime or from criminal or other negligence, and the personal representative of the deceased may recover them (O.C.G.A. § 51-4-5). Medical expenses are limited to the reasonable value of medically necessary care (O.C.G.A. § 51-12-1.1).

Some losses are easier to document than others. Lost income can often be shown with pay records. Loss of companionship is harder to put in numbers. Future economic losses may be reduced to present value, using a 5 percent discount rate or another rate the trier of fact considers appropriate (O.C.G.A. § 51-12-13).

Questions Families Often Ask About Settlement

A settlement offer should be measured against the evidence, the losses, and the risk of trial. A fair offer reflects how strong the proof of fault is and how well the losses are documented.

Georgia’s fault rules also shape the math. Under O.C.G.A. § 51-12-33(a), where the plaintiff is to some degree responsible for the injury or damages claimed, the trier of fact determines the plaintiff’s percentage of fault, and the judge reduces the damages awarded in proportion to that percentage. Families should weigh that risk when they compare an offer with a possible verdict.

The family makes the decision about whether to accept an offer. It is wise to take time to review the offer and any written terms before answering.

Timing often depends on how much evidence has been developed. It also depends on how the insurer responds. A settlement reached too early can leave important questions unanswered.

How to Think About the Odds in Your Family’s Situation

No one can responsibly predict whether a specific wrongful death case will be won or what it will be worth before the facts are known. Anyone who promises a result is ignoring how much the facts matter.

Several factors shape how a claim looks. These include the cause of death, the quality of the records, the number of responsible parties, and the insurance coverage behind them.

Fault is a central question. Under Georgia’s apportionment law, a plaintiff who is 50 percent or more responsible for the injury or damages claimed may not receive any damages (O.C.G.A. § 51-12-33(g)). The Georgia Supreme Court’s decision in Quynn v. Hulsey quotes this same apportionment rule.

Writing things down helps. Record the timeline of the incident, the medical care, every record received, and every call with an insurer. A clear file makes the next conversation easier for everyone.

Talk With Ugwonali Law Group About Your Family’s Situation

If someone you love died in a crash or fall, you may be grieving and researching this on their behalf.
