The family’s own insurance does not pay the claim. Georgia law also says who receives the recovery, which is a separate question. Here is how the two pieces fit together.

Who pays for wrongful death in Georgia?

The at-fault party’s liability insurance usually pays the claim. A wrongful death claim asks the person or business responsible for the death to compensate the family. The family is not the one paying. The claim is aimed at the responsible party and the insurance that covers that party’s legal liability.

The right policy depends on who caused the death. After a car crash, the driver’s personal auto policy may be the source. After a truck crash, the trucking company’s commercial policy often plays the central role. A commercial policy is written for a business, not a household. After a fatal fall on unsafe property, the property owner’s liability policy may be the source.

Georgia law makes a business answerable for harm its worker causes within the scope of that business. O.C.G.A. § 51-2-2 That is why a company can be the payer even when a driver made the mistake.

If you're sorting out who pays after a loved one's death, our team offers a free, confidential first consultation, in English or Spanish. That role includes the legal steps for the claim. The family member reading this may not be the one who files. Who may act is set by the family’s situation, including whether there is a surviving spouse or children.

Who receives the money from a wrongful death recovery?

The surviving spouse and the children share the recovery. When there is a spouse, the spouse receives at least one-third. O.C.G.A. § 51-4-2 The statute divides the amount equally among the spouse and the children, per capita (one share per person). The spouse’s share can never be less than one-third.

If there is no spouse, the children share the recovery equally, per capita. Descendants of a child take their parent’s share, by family line. The same statute says a recovery under this part is not subject to the decedent’s debts or the estate’s liabilities. Creditors of the person who died cannot reach it.

What a wrongful death recovery is meant to cover

Georgia measures the recovery by the full value of the decedent’s life, as the evidence shows it. Georgia’s wrongful death statute is available at O.C.G.A. § 51-4-2. It asks for the full value of the life of the decedent, as shown by the evidence.

Georgia also separates two kinds of damages. Special damages are actual losses and must be proved. O.C.G.A. § 51-12-2

O.C.G.A. § 51-4-5 To see how these losses fit a real crash, read an example of a wrongful death situation. For how a claim is built, see typical grounds for a wrongful death claim.

How insurance limits and commercial policies shape what is paid

The payer is the party found at fault, and that party’s coverage sets the practical limit. Georgia assigns fault by percentage among everyone who contributed to the harm. O.C.G.A. § 51-12-33 Each person pays only the share assigned to them. The law does not make them jointly liable, and there is no right of contribution between them. So when several drivers or companies share fault, each answers for its own percentage.

Under the same statute, a plaintiff who is 50 percent or more responsible for the harm recovers no damages (O.C.G.A. § 51-12-33; Quynn v. Hulsey (2020)). Fault is a central issue in these cases.

Claims against a motor carrier follow special rules. Georgia allows the carrier’s insurer to be joined in the same lawsuit only in specific situations. Those include when a related carrier is insolvent or bankrupt, or when the carrier or driver cannot be served after reasonable diligence. O.C.G.A. § 40-1-112

Federal rules set a $750,000 minimum public liability level for certain for-hire interstate trucks carrying nonhazardous property. That is a required insurance floor, not a measure of what any claim is worth. 49 C.F.R. § 387.9 The outcome depends on the facts of each case. Under a written fee agreement, the client may still owe case costs and expenses. Families should read that agreement closely before signing it.

Under O.C.G.A. § 51-4-2(b)(3), court approval of a minor child’s settlement applies only when there is no surviving spouse and the minor child brings the action.
