The case ends without an award for the family’s loss.

A wrongful death lawsuit is a civil claim. It is brought after someone dies because of another party’s wrongful act. Georgia law sets out who may bring it. Under O.C.G.A. § 51-4-2(a), a surviving spouse may recover for the homicide of a spouse or parent. The amount is “the full value of the life of the decedent, as shown by the evidence.”

When no one may bring the claim under those sections, the estate’s representative may. Each group works differently, and each can happen even when the death was tragic.

Georgia law defines negligence in plain terms. Under O.C.G.A. § 51-1-2, ordinary diligence is the care that “ordinarily prudent persons” use in similar circumstances. The absence of that care is ordinary negligence.

Under O.C.G.A. § 51-1-6, when the law requires a person to perform an act for the benefit of another or to refrain from doing an act which may injure another, the injured party may recover for the breach of that legal duty if they suffer damage from it.

Families often feel the loss was clear. Feelings alone do not answer those questions.

Failure to Prove Negligence and Insufficient Evidence

A case is often lost when the evidence does not clearly show what the defendant did wrong and how it led to the death. Strong proof is built early and kept intact.

Useful evidence often includes crash reports, medical and autopsy records, witness statements, photographs, and maintenance or inspection records. For vehicle crashes, data from the vehicle itself may also matter. For a fall on unsafe property, repair logs, incident reports, and prior complaints can help show what the owner knew.

Gaps hurt a case. So do conflicting accounts, missing records, and evidence that is lost or thrown away. A judge or jury may decide the proof does not show the defendant’s conduct caused the death.

Georgia law also looks at fault on both sides. Under O.C.G.A. § 51-12-33(a), the trier of fact sets the plaintiff’s percentage of fault. The judge then reduces the damages in proportion to that share. Under § 51-12-33(g), the plaintiff gets no damages at all if the plaintiff is 50 percent or more responsible.

Early preservation matters.

Procedural and Filing Errors, Including the Deadline

A case can end before anyone decides the facts if a deadline or court rule is missed. Procedure is not a technicality to ignore. It can decide whether the case is heard at all.

Georgia’s general deadline for actions for injuries to the person is two years. Under O.C.G.A. § 9-3-33, that time runs from when the right of action accrues. The statute also contains exceptions, so families should ask early how the deadline applies to their claim.

The deadline can sometimes pause. Under O.C.G.A. § 9-3-99, the limitation period for a tort claim by the victim of an alleged crime is tolled from the date of the commission of the alleged crime or the act giving rise to such action in tort until the prosecution of such crime or act has become final or otherwise terminated. That tolling may not exceed six years.

Other problems can also end a claim. Missed deadlines, the wrong parties named, improper service of the lawsuit, and missed court requirements all matter. Fulton County State Court, which has jurisdiction over civil cases including wrongful death, describes its electronic filing and attendance requirements for civil matters.

Families should write down the date of death and the date of any incident report. Then they should ask questions about timing early.

Court Costs and Litigation Expenses You May Still Owe

After a loss, a family may still be responsible for court costs and case expenses. This depends on the written fee arrangement, so families should review it before the case begins.

Litigation expenses are separate from attorney fees. They can include filing fees, records charges, deposition costs, investigation costs, and fees for professionals who review medical or accident evidence. These costs can arise whether or not the case is won.

Ask how costs are handled in a loss. Ask whether costs are advanced during the case and how they are repaid. Ask whether any amount is taken from a recovery. Our page on wrongful death lawsuit costs explains these terms in more detail.

Costs can also follow a dismissed case. Under O.C.G.A. § 9-11-41(d), a plaintiff who dismisses an action and later files again on the same claim against the same defendant must first pay the court costs of the earlier case.

Get the fee terms in writing. Know what you may owe in each outcome before you sign anything.

Who Pays in a Wrongful Death Lawsuit

When a claim succeeds, payment usually comes from the at-fault party. Often it comes through that party’s liability insurance, including a commercial policy in a trucking case. When a claim is lost, the family receives no payment on that claim.

Georgia law also sets rules for dividing a recovery. Under O.C.G.A. § 51-4-2(d)(2), a surviving spouse receives no less than one-third of the recovery. Under § 51-4-2(d)(1), any amount recovered under subsection (a) of this Code section is otherwise divided equally, share and share alike, among the surviving spouse and the children per capita, and the descendants of children take per stirpes. Under § 51-4-2(e), a recovery under that section is not subject to the decedent’s debts.

Certain expenses can also be recovered. The timing depends on the facts, the evidence, the court’s schedule, and whether the parties reach agreement.

Most cases move through a few stages. First comes investigation and gathering records. Then the case is filed and the parties exchange information in discovery. Next, the parties may talk about settlement or try mediation. If the case does not settle, it may go to trial.

A loss can come at any stage. A case can be dismissed. A judge can rule for the defense on a key question. A jury can return a verdict for the defense at trial.

Fault can also be assigned to others. Under O.C.G.A. § 51-12-33(c), the trier of fact considers the fault of all persons who contributed to the injury, whether or not they were named in the suit. This can change how a case unfolds and how damages are divided.

Is Pursuing a Wrongful Death Claim Worth It?

Whether to pursue a claim is a personal decision. Families weigh the evidence, the costs, the timing, the emotional toll, and their own goals.

The strength of the evidence matters most at the start. A family should ask what proof exists, what is missing, and how quickly it can be preserved. The cost and timing of the process matter next. Litigation can be slow, and it can bring hard questions about the person who died.

The emotional side matters too. Some families want answers and accountability. Others want to focus on healing. Both choices are valid.

There is no single answer that fits every family. A first conversation can help you see how these factors apply to your own situation.

Questions Families Often Ask Before Deciding

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What are the odds of winning?

Outcomes depend on the evidence, the law, and the decision makers.
