Under O.C.G.A. § 9-3-70, an “action for medical malpractice” means any claim for damages resulting from the death of or injury to any person arising out of health, medical, dental, or surgical care or service, or care or service at a hospital, nursing home, clinic, or similar facility. The claim must arise from health, medical, dental, or surgical service, diagnosis, prescription, treatment, or care rendered by a person authorized by law to perform it, or by any person acting under the supervision and control of the lawfully authorized person, or from care or service rendered by any public or private hospital, nursing home, clinic, hospital authority, facility, or institution, or by any officer, agent, or employee thereof acting within the scope of his employment.

A family may be able to bring this as a wrongful death claim based on medical negligence. The medical side asks whether the care went wrong. The wrongful death side asks who may sue and what the family may recover.

Many families first hear these terms in a painful moment, often while still making funeral plans. Taking them one step at a time helps.

If you're piecing together a loved one's hospital records after an unexpected death, our team can talk those records through with you in English or Spanish. Medical negligence can be that wrongful act.

Georgia’s statute uses the word “homicide” in a legal sense. It includes a death that results from a crime, from criminal or other negligence, or from property which has been defectively manufactured, whether or not as the result of negligence. That is explained in O.C.G.A. § 51-4-1. In this setting, the word includes all cases in which the death of a human being results from a crime, from criminal or other negligence, or from property which has been defectively manufactured, whether or not as the result of negligence.

Under O.C.G.A. § 51-4-2, a surviving spouse may bring the claim for the death of a spouse, and if there is no surviving spouse, a child or children may bring the claim for the death of a parent. If there is no surviving spouse, a child or children may bring it. When a spouse shares in a recovery, the spouse receives no less than one-third.

O.C.G.A. § 51-4-5 also lets the personal representative seek funeral, medical, and other necessary expenses when a death results from a crime or from criminal or other negligence.

The law measures loss by “the full value of the life of the decedent.” Under § 51-4-1, that value is counted without subtracting what the person’s own necessary or personal expenses would have been had they lived.

For a broader overview, read our Georgia wrongful death guide.

What a Family Generally Needs to Prove

A medical negligence death claim usually asks four questions. Was there a duty of care? Was that duty broken? Did the break cause the death? What losses followed?

Georgia defines ordinary negligence as the absence of ordinary diligence. That is the care that ordinarily prudent people use in similar circumstances, as stated in O.C.G.A. § 51-1-2.

In a medical setting, a breach might look like a warning sign that was charted but never acted on. That is an example, not a prediction about any case.

Causation is often the hardest question. A seriously ill patient may have died from that illness, so careful review of the timeline is usually needed.

General damages are those the law presumes flow from a wrongful act. Special damages must be proved, as explained in O.C.G.A. § 51-12-2. Funeral bills and medical bills are typical special damages.

Medical records, the death certificate, and sometimes autopsy findings usually show these elements.

Common Situations Where Medical Errors Lead to Death

Fatal medical errors often fall into a few patterns. Whether one of these fits your family’s situation depends on the facts of the case.

Surgical mistakes, including errors during the operation or in monitoring after surgery.

Hospital infections that were not spotted or treated as the patient got worse.

Objects left inside the body after a procedure. Georgia has a separate timing rule for these, covered below.

Childbirth complications where warning signs were missed or not acted on in time.

Delayed or missed diagnoses, where a treatable condition was not found in time for care.

In each pattern, the key questions are the same. What care was given, when was it given, and did it meet the standard a prudent provider would meet?

Families often find the answers in the chart. Notes, orders, and lab results show what the team knew and when.

Can a Family Sue a Hospital or Other Provider?

A claim may name the treating doctor, nurses, a hospital, or another health care organization. Which parties are involved depends on who gave the care and how.

Georgia’s definition of a medical malpractice action reaches care at hospitals, nursing homes, and clinics. It also reaches their employees acting within the scope of their jobs, under O.C.G.A. § 9-3-70.

A single hospital stay can involve many caregivers. The admitting team, floor nurses, surgeons, and discharge staff may each play a part.

That is why the records matter. They show who provided each step of care, and when they provided it.

Records, Timing, and Why Early Review Matters

Start with the records. Families commonly gather hospital and clinic charts, discharge summaries, imaging, lab results, medication records, and the death certificate.

Timing is strict. Under O.C.G.A. § 9-3-71, a medical malpractice action generally must be brought within two years after the injury or death occurred. It may not be brought more than five years after the negligent act or omission.

For a foreign object left in the body, the general limits do not apply. For a foreign object left in a patient’s body, the action must be brought within one year after the negligent or wrongful act or omission is discovered, under O.C.G.A. § 9-3-72. The term “foreign object” does not include a chemical compound, fixation device, or prosthetic aid or device.

Because deadlines are strict, learning your options early helps. That is true even before you decide whether to file.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is fatal medical malpractice?

It is medical negligence that causes a patient’s death.
