That includes personal injury and wrongful death suits in Georgia courts. Someone who runs their own case without an attorney is called a self-represented litigant, or pro se.

Every filing, deadline, and hearing falls on that person.

A person can also hire a lawyer at any point in a case, including after filing. Some people do this when a case becomes more complex. The rest of this page explains the steps, the risks, and who can bring a wrongful death claim in Georgia.

What it means to be a self-represented litigant

Being self-represented means you handle every task a lawyer would handle. You draft the filings, track every deadline, and make sure the other side receives a copy of each document. You also respond to the other side’s motions and attend each hearing.

Most of this happens in writing. Keep a complete file of everything you send and receive. Note dates and names in one place so you can find them later.

The same procedural rules apply whether or not a lawyer is involved. Each step has its own requirements, so plan time to read the rules before every filing.

The basic steps to start a civil lawsuit

Starting a suit means naming the right defendant, filing a complaint, and getting the defendant served.

Once the complaint is filed, the clerk must issue a summons for service. The Georgia process rules under O.C.G.A. § 9-11-4(a) say so. Service can be made by a certified private process server. The Georgia Office of Court Administration rules say certified private process servers may serve process in a civil lawsuit.

Timing matters from the start. Georgia generally allows two years to sue over injuries to a person, but injuries to the reputation must be brought within one year and loss of consortium actions within four years, under Georgia’s injury filing deadline (O.C.G.A. § 9-3-33).

Motions and procedure: what a self-represented party may face

A motion to dismiss asks the judge to end a case before it moves forward. Defendants use it to challenge the complaint itself. Under O.C.G.A. § 9-11-12, failure to state a claim is a listed defense, as set out in Georgia’s answer and defenses rules. It may also be made in any pleading, by motion for judgment on the pleadings, or at trial. O.C.G.A. § 9-11-12 reads: “The defenses specifically enumerated in paragraphs (1) through (7) of subsection (b) of this Code section, whether made in a pleading or by motion, and the motion for judgment mentioned in subsection (c) of this Code section shall be heard and determined before trial on application of any party unless the court orders that the hearing and determination thereof be deferred until the trial.”

If you receive one, read the motion closely. Identify the legal standard it argues. File a written response by the court’s deadline, and ask for a hearing when the rules allow.

If a defendant files this motion before answering the complaint, discovery is put on hold while the motion is pending. Under O.C.G.A. § 9-11-12(j)(1), that pause ends right away if the defendant files an answer before the court decides the motion. The court must decide the motion within 90 days after briefing ends. Under O.C.G.A. § 9-11-41, a plaintiff may dismiss an action without order or permission of court by filing a written notice of dismissal at any time before the sixtieth day following the date the opposing party serves an answer. Arrive early and dress neatly. Address the judge as “Your Honor,” and wait to be recognized before you speak.

Stay on the question asked. Judges often limit or redirect statements that don’t bear on the issue. Be clear and brief. Label each exhibit and keep them in order before the hearing.

Testimony works best when it sticks to what the witness saw, heard, or did. Separate firsthand knowledge from guesses and beliefs. Write down every ruling and instruction the judge gives. Confirm every deadline in writing, and keep a copy of each order.

Who can bring a wrongful death claim in Georgia

Under Georgia law, a surviving spouse may recover for the homicide of a spouse. If there is no surviving spouse, a child or children may recover. Under Georgia’s wrongful death statute (O.C.G.A. § 51-4-2(a)), the recovery is the full value of the decedent’s life, as shown by the evidence.

When there is a surviving spouse, that spouse receives no less than one-third of the recovery (O.C.G.A. § 51-4-2(d)(2)). A recovery under that section is not subject to the decedent’s debts or liabilities (§ 51-4-2(e)).

A different route is described in O.C.G.A. § 51-4-5: when there is no person entitled to bring a wrongful death action under O.C.G.A. § 51-4-2 or § 51-4-4, the administrator or executor of the decedent may bring the action for the benefit of the next of kin. When a death results from a crime or from criminal or other negligence, the personal representative may recover funeral, medical, and other necessary expenses.

A family member who files should also learn the deadlines and estate steps that may apply. Grief, medical records, and calls from an insurer can all arrive at once.

Risks and tradeoffs of going without a lawyer in serious injury cases

Serious injury cases bring large files. Truck crashes, traumatic brain injuries, spinal cord injuries, and fatal accidents often involve medical records, opinions from treating doctors, and questions about insurance coverage.

Insurance companies often work these claims through their own defense lawyers. A person filing alone faces that process without a lawyer at their side.

Georgia law treats necessary expenses from an injury as a legitimate part of the damage estimate. See Georgia’s damages statute (O.C.G.A. § 51-12-7).

A lawyer can explain the deadlines, the evidence a claim needs, and how damages are measured. Whether to file alone depends on the facts of each case.

Court costs and case expenses are part of a lawsuit whether or not a lawyer is involved. A person who files alone is responsible for them.

Talk with our team about your situation

You may be reading this for someone you love.
