In Georgia, there is no single answer. Each claim depends on its own facts, and no fixed formula sets the number. This guide explains the Georgia rules that shape value, so a family can read any offer with a clearer view. It is general information for people dealing with a death from a crash or a fall on unsafe property.

Why There Is No Single Highest Payout Figure

No single highest payout applies to every wrongful death claim. Georgia law lets a surviving spouse, or if there is no surviving spouse, a child or children, seek “the full value of the life of the decedent, as shown by the evidence” (O.C.G.A. § 51-4-2). The evidence shapes the number. No published table does.

A death in a truck or car crash, or on unsafe property, can involve more than one party. Each party may have its own insurance. Georgia law requires the decision-maker to consider the fault of everyone who contributed to the harm, whether or not each person was sued (O.C.G.A. § 51-12-33). That can mean several defendants and several policies. For an overview of the claim, read our wrongful death guide.

If someone you love died in a crash or a fall, our team can help you talk through the facts and the next steps, whenever you're ready. If there is no surviving spouse, the children may bring it (O.C.G.A. § 51-4-2).

The statute also sets how the money is shared. The statute cited here sets the recovery as the full value of the life of the decedent; the spouse’s share of no less than one-third is in O.C.G.A. § 51-4-2(d)(2). Attorney fees, case costs, and other claims against a settlement can reduce what a family keeps. Look at each of these items before you agree to anything.

What Damages Families Can Seek in Georgia

Georgia lets families seek the full value of the decedent’s life, along with specific financial losses. Some losses are presumed and some must be proved. General damages are those the law presumes from a wrongful act, and they need no proof of an amount. Special damages actually flow from the act, so they must be proved (O.C.G.A. § 51-12-2).

Funeral and burial costs are one example. A personal representative may recover funeral, medical, and other necessary expenses when a death results from a crime or from criminal or other negligence (O.C.G.A. § 51-4-5). Keep every receipt and bill. Learn more about funeral and burial costs after a fatal crash.

Medical expense damages are limited to the reasonable value of medically necessary care, treatment, or services (O.C.G.A. § 51-12-1.1). Future losses such as lost wages may be reduced to present value. The decision-maker may use a 5 percent discount rate or another rate it finds appropriate (O.C.G.A. § 51-12-13). Evidence about the decedent’s age, health, work, and role in the family often matters to the full value of life.

Factors That Shape the Value of a Claim

The main factors are who died, how the event happened, what insurance applies, and what the evidence shows. These factors work together, so one factor rarely decides a claim alone.

The decedent’s life. Age, health, earning history, and the support and household help the person gave.

Clarity of fault. How the crash or fall happened, and which records show it.

Shared fault. Georgia reduces damages in proportion to any fault assigned to the plaintiff, and bars recovery at 50 percent or more (O.C.G.A. § 51-12-33).

Available insurance. A policy’s limits set a practical ceiling on what that policy pays. Records tied to those rules can matter in a truck case.

Proof of loss. Clear medical records and economic evidence support each category of damages.

Punitive Damages and the Georgia Statutory Limit

Punitive damages are different from compensation. Georgia law says they are awarded “not as compensation to a plaintiff but solely to punish, penalize, or deter a defendant” (O.C.G.A. § 51-12-5.1).

In a tort case outside the statute’s exceptions, punitive damages are capped at $250,000. The statute has exceptions. Product liability cases are not subject to the cap on punitive damages. Under O.C.G.A. § 51-12-5.1 (Clark v. Leigh (and Vice Versa) (2026))(f), the limit on punitive damages does not apply if the trier of fact finds that an active tort-feasor acted, or failed to act, with specific intent to cause harm, or while under the influence of alcohol, drugs other than lawfully prescribed drugs administered in accordance with prescription, or any intentionally consumed glue, aerosol, or other toxic vapor, to the degree that the person’s judgment is substantially impaired. Such damages are not the liability of any defendant other than an active tort-feasor.

Punitive damages are not part of every claim. They must be specifically requested in the complaint, and they require proof that fits the statute.

How to Read a Settlement Offer and What a Trial Involves

Some claims settle through negotiation, and some go to trial. An early offer may arrive before the medical bills, earnings records, and funeral costs are fully known. Read the offer line by line.

Check whether it covers every category of damages. Check whether it accounts for medical bills and any liens. Check the insurance limits behind it. Understand the release before anyone signs it.

The total settlement is not the same as the amount a family keeps. Case costs, medical claims, and fees can come out first. If a case does not settle, it may go to trial. What a wrongful death trial involves explains that process.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Online Calculators Cannot Answer This Question for Your Family

Online calculators cannot estimate your family’s claim. They don’t know the decedent’s earnings history, the family’s losses, the evidence of fault, or the insurance behind the other side. An average from other cases describes those cases, not yours.

Timing matters too. Georgia sets a two-year deadline for actions for injuries to the person after the right of action accrues, except for loss of consortium claims, which must be brought within four years, and injuries to reputation, which must be brought within one year (O.C.G.A. § 9-3-33). A wrongful death claim has its own timing rules, and the facts decide which rules apply. Early review helps protect time.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is the highest payout for wrongful death in Georgia?

There is no fixed highest payout.
