Not exactly. Premises liability is a type of personal injury claim. It covers harm caused by an unsafe condition on someone’s property.

If you’re reading this after a fall or another accident, you may be trying to make sense of a stressful situation. This guide explains the terms in plain language, using Georgia law. It’s general information, not advice about your own case.

Premises liability is one kind of personal injury claim

Premises liability is a branch of personal injury law. Personal injury is the broad category. Premises liability is the set of claims where the injury happened because of a dangerous condition on property.

People often use the two terms as if they mean the same thing. That shorthand is common, but it can blur the picture. A car crash claim is a personal injury claim, but it isn’t a premises claim. A fall on a wet store floor can be both.

Knowing where your situation fits helps you ask the right questions early.

If you were hurt on someone else's property and are still sorting out what that means, our team is glad to talk it through with you, with no obligation to continue. That act might be careless, intentional, or dangerous. Common examples include car and truck crashes, falls, and medical harm. These events can lead to fractures, hospital stays, and long-term treatment from a medical doctor.

Most personal injury claims rest on negligence. Negligence means someone owed a duty of care didn’t meet it, and another person was hurt as a result. Georgia law allows an injured person to recover when another person breaks a legal duty and the injured person suffers damage O.C.G.A. § 51-1-6.

Georgia also separates two kinds of damages. Special damages actually flow from the act and must be proved O.C.G.A. § 51-12-2. That’s why good records matter from the start.

What premises liability means under Georgia law

Premises liability deals with injuries caused by unsafe property. Common examples include floors, stairs, parking lots, walkways, and building structures. In Georgia, the main rule comes from O.C.G.A. § 51-3-1. An owner or occupier who invites or leads people onto its premises for a lawful purpose is liable for injuries caused by failing to use ordinary care to keep the premises and approaches safe.

Ordinary care is the standard the law uses here. The claim focuses on the property. What was the condition? Did the owner or occupier take reasonable steps to keep the area safe? Those are the core questions.

Safety standards can show what a safe surface looks like. The OSHA walking-working surfaces standards address slip, trip and fall hazards. They are workplace rules, so they serve as a reference point. The Georgia Department of Community Affairs explains that Georgia has statewide and locally adopted construction codes.

Why the visitor’s legal status shapes the claim

Visitor status matters because it changes the duty an owner owes. Georgia law defines a licensee as someone who is neither a customer, a servant, nor a trespasser. Under O.C.G.A. § 51-3-2, a licensee is a person who is neither a customer, a servant, nor a trespasser, who does not stand in any contractual relation with the owner of the premises, and who is permitted, expressly or impliedly, to go on the premises merely for his own interests, convenience, or gratification. For a licensee, the owner is liable only for willful or wanton injury.

An invitee is different. Under O.C.G.A. § 51-3-1, an owner or occupier of land who, by express or implied invitation, induces or leads others to come upon the premises for any lawful purpose is liable in damages for injuries caused by a failure to exercise ordinary care in keeping the premises and approaches safe. A shopper in a store is a common example. That is a different standard than the licensee rule.

Visitor status is a fact question. Each situation turns on its own facts, so the category has to be worked out case by case.

What has to be proven in a premises liability claim

Four ideas sit at the center of a premises claim. First, an owner or occupier who, by express or implied invitation, induces or leads others to come upon the premises for any lawful purpose owed them a duty of ordinary care. Second, the owner failed to use that care. Third, that failure caused the injury. Fourth, the injured person suffered damage. The rules on property owners and on breach of a legal duty frame these points.

Georgia also looks at each person’s share of fault. A judge reduces damages in proportion to the injured person’s percentage of fault. An injured person who is 50 percent or more responsible cannot recover damages O.C.G.A. § 51-12-33.

Evidence matters. Helpful items include photos of the hazard taken soon after the injury, incident reports, names of witnesses, and medical records showing treatment.

Premises liability versus personal liability: where the confusion starts

Personal liability is a different idea. It generally refers to a person’s own legal responsibility for a debt or obligation. Personal injury is the harm a person suffers. The two are not the same.

The mix-up is common. Someone types “personal liability” when they mean personal injury. Comparison pages often list the two terms side by side, which can make them look like rival categories. They aren’t. One describes responsibility for money owed. The other describes an injury.

Here’s a simple way to hold it. Personal injury is the harm. Premises liability is one legal path when that harm comes from a condition on property. Other personal injury claims, like car crashes, follow other paths.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Common settings and what they look like in practice

Premises claims can arise in many places. Common settings include retail stores, restaurants, apartment buildings, parking lots, construction sites, and private homes. A wet floor inside a store, a broken stair in an apartment building, or an uneven parking lot each raises its own questions.

A trip and fall is one common type. It often involves torn carpet, a raised threshold, or an uneven sidewalk. A slip and fall often involves a slick surface, such as a spill. Both are examples of premises claims when a property condition is involved.

These examples show the range of places the law can cover. Not every fall is a premises claim. Not every premises claim involves a fall.

Timing and next steps if you or a family member was hurt on someone else’s property

Georgia generally requires that actions for injuries to the person be brought within two years after the right of action accrues O.C.G.A. § 9-3-33. The statute has exceptions, so the exact timing can depend on the facts. Early attention to the date of the injury matters.

While memory is fresh, keep a few things. Save medical records and bills. Follow the treatment plan from a medical doctor. Keep photos of the hazard and write down witness names and contact details. A simple written timeline helps too.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is premises liability the same as personal injury?

Premises liability is a type of personal injury claim.
