Owners and occupiers must use ordinary care to keep their property safe for people invited there.

This guide explains how that duty works, what a claim may involve, and why timing matters. It focuses on falls that caused real injuries, such as fractures, head or spine injuries, and treatment by a medical doctor or hospital care. It is general information, not advice about your specific case.

What a Slip and Fall Claim in Cobb County Covers

A slip and fall claim is a legal claim for injuries caused by a fall on property that someone else owns, controls, or maintains. A slip usually happens on a slick surface, such as a wet floor. A trip happens when a foot catches on something, such as an uneven step, torn carpet, or a cord.

Both kinds of falls fall under premises liability. They can happen in stores, restaurants, apartment complexes, parking lots, and offices across Cobb County, including in Marietta, Smyrna, Kennesaw, and Acworth. The setting matters, but so do who controlled the area and what condition caused the fall.

This page covers falls that caused serious injury and required medical care. It does not cover minor incidents with no treatment. For the broader framework, read our Georgia slip and fall overview.

If you were hurt in a fall on someone else's property in Cobb County and are deciding whether to pursue a claim, our team can talk through your situation with you. Georgia law says an owner or occupier who invites people onto land for a lawful purpose owes them ordinary care in keeping the premises and approaches safe, as set out in O.C.G.A. § 51-3-1. A shopper in a store is an example of a person invited for a lawful purpose.

Visitor status matters. O.C.G.A. § 51-3-2 defines a licensee as someone who is not a customer, servant, or trespasser, has no contract with the owner, and goes onto the property only for their own interests, convenience, or gratification. The owner is liable to a licensee only for willful or wanton injury. So a fall review starts with how the person came to be on the property.

Responsibility can rest with the owner, a management company, a tenant that controls the area, or a contractor working there. The answer depends on who controlled the area where the fall happened. A commercial liability insurance policy may stand behind the responsible party. Insurance may influence how a claim is handled, but it is only one factor.

What Georgia Law Requires You to Show

Was the injured person lawfully on the property? Did the owner fail to use ordinary care to keep it safe? Did that failure cause the fall and the injury? The duty and causation language appears in O.C.G.A. § 51-3-1.

Common hazards include spills, uneven flooring, unmarked wet floors, broken steps, and poor lighting. How long a hazard existed may bear on what the owner knew. Federal workplace guidance also covers these risks. OSHA’s walking-working surfaces guidance offers general information about slip, trip, and fall hazards. Every case turns on its own facts, so this is general information, not a prediction.

Evidence That May Strengthen a Cobb County Fall Claim

Photos, incident reports, witness names, and records of the hazard may help show what caused a fall. Start with what you can safely document. Take photos of the spot, the hazard, the lighting, and any warning signs or missing signs. Write down the date, the time, and what you were doing.

Time matters. Video systems may overwrite older footage, and cleanup may remove the hazard. Ask the property for an incident report while the details are fresh. Keep the shoes and clothing you wore, since they may be relevant.

Records can show what the owner knew. Maintenance logs, inspection records, and prior complaints about the same spot may help. Do not confront the property owner or an insurer about fault, and do not alter the scene yourself.

Medical Care and Records After a Fall

Get a medical evaluation promptly after a fall, especially with head injuries, back or neck pain, or suspected fractures. Follow the treatment plan your doctor gives you, and keep your appointments. Emergency care treats the immediate problem. Follow-up visits check your progress. Therapy or care from other physicians addresses longer-term needs. You can learn more about traumatic brain injury and spinal cord injury on our site.

A claim relies on documentation. Medical records, imaging, and itemized bills create the record. Gaps in treatment may be questioned. O.C.G.A. § 51-12-1.1 limits medical expense damages to the reasonable value of medically necessary care, and the trier of fact decides that amount.

If you have health insurance, the evidence may include both the amounts charged and the amounts needed to satisfy those charges under the insurance contract (§ 51-12-1.1(c)). Either side may challenge the reasonableness of expenses or the medical necessity of treatment (§ 51-12-1.1(f)). Your medical care comes first. Your legal questions are a separate matter.

Georgia’s Filing Deadline and Comparative Fault Rule

For traumatic injuries, Georgia generally requires an injury lawsuit to be filed within two years of the date of injury, as provided in O.C.G.A. § 9-3-33. The clock does not wait for a later date you choose.

A fatal fall raises different questions. O.C.G.A. § 51-4-5 provides that, when no one else may bring a wrongful death action, the administrator or executor may bring it for the next of kin. The recovery is the full value of the decedent’s life. The personal representative may also recover funeral, medical, and other necessary expenses (§ 51-4-5(b)). The deadline for a wrongful death claim is a separate legal question, and this page does not answer it.

Georgia also applies a modified comparative fault rule under O.C.G.A. § 51-12-33. O.C.G.A. § 51-12-33 provides that damages are reduced in proportion to the injured person’s percentage of fault (O.C.G.A. § 51-12-33). A person found 50 percent or more responsible is not entitled to receive damages (§ 51-12-33(g)). When more than one party is liable, each pays only its own share, and the shares are not joint (§ 51-12-33(b)).

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions People Ask About Slip and Fall Settlements and Value

Results in a slip and fall claim depend on the facts, the evidence, and the law.
